Terms and conditions for Den4Dog App users

Please read these Terms and Conditions carefully before using the Den4Dogs App and dens (the Service). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

Here is a short summary of the most important stuff:

  • You are responsible for your own dog and proper use of the Den4Dogs service:
    • You can keep your dog(s) in the den for maximum 1 hour.
    • Make sure to give your dog necessary training in order to be confident staying in this kind of den/cage, as well as training to stay alone (away from you).
    • If your dog seems anxious or very unwilling to stay inside the den, you must give it more training, or choose not to use the den.
    • Be precautious on hot summer days, –You should give your dog fresh water before leaving it in the den, or eventually bring a bowl and water bottle, so you can leave water for the dog inside the den. Remember maximum 1 hour. Check on your dog more often on extra hot summer days. When the temperature in the den is above 20 degrees Celsius, a temperature-controlled fan automatically turns on and provide plenty of fresh air for the dog. The fan provides approximately the same temperature conditions in the den as the shadow temperature outside. Notice that it is a fan, not air condition. It does not cool and dry the air.
    • Show yourself as a role model, and, make sure the den is clean after your dog’s visit. Eventually remove any scumber, and contact the store staff at the location for cleaning. Anyway – dogs usually do not do poop in the den, same as when they are indoors. The dens are disinfected with UVC light after each dog visit, and is regularly cleaned according to a cleaning program by cleaning staff.
  • Make sure your mobile phone / tablet is functioning normally and have sufficient network coverage, available data traffic, and battery capacity to both lock and unlock the den.
  • We will send you push notifications on your smartphone in order to make the “your-dog-in-den-session” as safe and secure as possible. This will be information about using the service, tips, etc.
  • You need to select a payment method and register payment information in order to pay for the service where this is required.
  • Den4Dogs is committed to secure your privacy information. Den4Dogs processes your personal information in accordance with the Norwegian Personal Data Processing Act. The rules protect you against abuse of your personal information.

 

This agreement is valid from the date you accept the terms and conditions.

The following agreement is between you (“Customer”) and Den4Dogs AS, and governs your rights and obligations using the Den4Dog App and services (“Service”).

The customer may use the Service to temporarily place his/hers dog(s) in Den4Dogs dens in public places, as well as pay for this and other services offered by Den4Dogs and Den4Dogs partners. Information about available services offered by Den4Dogs can be found at www.Den4Dogs.no.

 

  1. User account

In order to use the Service, the Customer needs to be a private person above 15 years of age, and need to be identified by entering the Customer’s mobile phone number. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the Service.

It is not permissible to create more than one user account per person, and the Customer needs to ensure that registered information is correct and complete when registering and using the Service. The Customer’s User-account will be created as soon as the Customer has accepted the Den4Dogs Terms of Use. As a user of the Service, the Customer is responsible for all activity and transactions related to his / hers user account.

The Customer can terminate the user account at any time. The user account will be deleted by sending an request by email to [email protected]

Den4Dogs AS reserves the right to approve a new customer, change or delete content, delete Customer’s User Account and / or deny Customer access to the Service if:

  • Den4Dogs suspects that more user accounts are associated with the same person
  • Den4Dogs suspect that the Service is used for purposes other than temporarily stalling of your dog, such as other storage, resale or business activities.
  • There are other substantial reasons

Before Den4Dogs delete the Customers user account, the account will be blocked temporarily. The customer will receive a notice about the blocking, and will be given the opportunity to explain his/hers use of the Service. If the user account is deleted, the Customer will not be allowed to create a new user account again.

The Customers rights and obligations regarded to complaints and cancellation are governed by the Norwegian Consumer Purchase Act and the Norwegian Law for Rights of Cancellation. However, the Customer can choose to terminate the agreement and request deleting of account at any time.

 

  1. Communication

In order to make the Customer’s user experience best possible, Den4Dogs will provide the Customer with information about using the service, tips and offers on products through push notifications on the mobile. The providers of the offers will be limited to Den4Dogs, Den4Dogs partners, and stores / companies that have the Den4Dogs Service outside their storefront.

Den4Dogs will only send push notifications if the Customer has agreed in advance. However, it is required that the Customer accept push notifications in order to use the Service. This is because Den4Dogs uses push notifications to send crucial information regarding security when using the service, for example, the dog has been in the den longer than the recommended time limit, or if risk related to the dogs health due to high/low temperature in the den. On iOS units, Customer can allow / deny push notifications in the units “Settings”. On Android, the Client may change this directly in the application, in Settings.

 

  1. Customer’s obligations

If the Service is unavailable or not operating functionally, the Customer shall inform Den4Dogs or service staff in the store at the location where the actual den is located. Den4Dogs is not responsible if the customer cannon access the service due to the Customer’s mobile phone does not work or is discharged, if the Customer’s mobile phone operator has problems which means that the customers phone may not have network coverage or available data traffic, or other matters beyond Den4Dog’s control that prevent the Service from being used.

The customer is responsible for correctly using the service in accordance with the dogs needs and behavior. The door of the selected den can unlocked by the “Slide to open”-button in the Den4Dogs App. The door lock reactivates automatically after 20 seconds, and will lock when the door is closed. To ensure that the parking timer has started, the Customer must wait for a confirmation on the Den4Dogs App Status Screen. It is the Customer’s responsibility to manually terminate the session in the App by unlocking the door of the den used.

The Customer shall indemnify Den4Dogs for all claims and disputes between the Customer and third parties, including such as the store/ company where Den4Dogs service is located, public authorities, credit card company, financial institutions and mobile phone operators.

It is the Customer’s responsibility that the registered debit or credit card is valid, has coverage and is not blocked. The customer is responsible for submitting new credit or debit card details at least 30 days before the card expires.

The Customer undertakes to indemnify Den4Dogs for any claim that a third party may have against Den4Dogs as a result of Customer’s use of the Service.

 

  1. Customer’s obligations for correct use of Den4Dogs Service (the den)
  • The customer shall not keep dogs in the den for more than MAXIMUM 1 HOUR.
  • The dog should be trained to be in this kind of den, as well as being trained to be alone.
  • Make sure the dog is comfortable when placed in the den. Spend some time the first few times and make sure this will be a positive experience for the dog. – bring some treats and familiar items and place in the den along with your dog, and check on it often at the first few times you use the den. If the dog has never been in the den before, or suffers from even a slightest form of “separation anxiety”, it should be trained for the new situation the first time you use the den.
  • If the dog shows signs of anxiety or strong unwillingness to be placed in the den, more training is needed, or you should avoid using the den for your dog.
  • On hot summer days, when the shadow temperature exceeds 25 degrees, the dens should be used with some precaution. The Customer should give the dog fresh water before leaving it in the den, or eventually bring a bowl and water bottle, and leave the water for the dog inside the den. Remember maximum 1 hour. Check on the dog more often on extra hot summer days. When the temperature in the den is above 20 degrees Celsius, a temperature-controlled fan automatically turns on and provide plenty of fresh air for the dog. The fan provides approximately similar temperature conditions in the den as the shadow temperature outside. Notice that it is a fan, not air condition. It does not cool and dry the air.
  • Show yourself as a role model, and, make sure the den is clean after your dog’s visit. Eventually remove any scumber, and contact the store staff at the location for cleaning.   • The customer must ensure that the mobile phone / tablet used for Den4Dogs App operates normally and has sufficient network coverage, data traffic and battery to lock / unlock the doghouse.

 

  1. Payment through Den4Dogs-App

In order to allow the Customer using the Service, the Customer must provide the following information to Den4Dogs: Real persons are required to register their name, registered address, date of birth, and nationality. The customer must provide his/hers telephone number and email address. In addition, the Customer must select payment method and register payment information necessary to create a valid billing relationship between Den4Dogs and the Customer.

The Customers is responsible to ensure that correct user information and information about the Customer’s dog is registered in his/hers user account at all times. Den4Dogs disclaims any liability in connection with incorrect registrations.

Payment for a “dog-parking-session” using Den4Dogs App and service, is initiated by the Customer choosing a den for his / hers dog, and unlocking the door by using the Den4Dogs App. The price for usage of the relevant den is provided in the Den4Dogs App, and this price is considered the valid and correct price, no matter what price is stated on the den or other places.

Once the Customer has initiated the use of a den by unlocking the door, Customer agrees that Den4Dogs will charge the amount of the use, including applicable fees and service fees. The final price is calculated immediately when the dens door is opened again to take out dog. The price is a combination of fixed price per occasion, and the time the den has actually been used. The user session ends when the Customer unlock the door to take the dog out.

The Service can only be used on Den4Dogs units. The locations and dens are listed on Den4Dog’s website, and on the map in Den4Dogs App.

 

5.1 Verification of transactions

Details about Customer’s transactions are stored in real time on the Customer’s Den4Dogs account, and can be requested by sending an email to [email protected]. The Customer can also view payment history on his/hers own bank account, as the transactions are made after each session of using the dens. Den4Dogs stores the Customer’s transaction information for a minimum of 12 months.

 

5.2 Complaints and investigations regarding Den4Dogs transactions

If the customer want to complain about any transactions made to Den4Dogs, Den4Dogs needs to be informed about the case as soon as possible, and not later than 60 days after the relevant transaction has been completed. The complaint must clearly state the reason for the complaint. If this is not clear, the Customer will lose the right to invoke the possible error. When the Customer files a complaint, Den4Dogs will conduct a technical investigation unless special reasons arise against it.

When and if a complaint is accepted, Den4Dogs will compensate the amount from the actual transaction to the Customer. Den4Dogs will inform the Customer if the complaint is rejected. If the customers disagree to the rejection, the Customer may bring the decision further to the Norwegian Consumer Council (free service).

 

  1. User data

Den4Dogs is committed to keep the Customer’s privacy information safe. Den4Dogs maintain the Customer’s personal information in accordance with the Norwegian Personal Data Processing Act of April 14, 2000, No. 31, and its corresponding regulations. The regulations protect the Customer against abuse of personal data.

Den4Dogs ensures that unauthorized persons can not access the Customer’s personal information registered by the Den4Dogs App. Den4Dogs uses several forms of security technology that provide excellent protection against unauthorized access and abuse of the Customer’s personal information.

Access, registration and use of the Service will result in processing of Customer’s personal information. The personal information to be processed is the Customer’s name, address, phone number and email address, and the information the Customer voluntarily chooses to share in Den4Dog’s App. The purpose of processing this personal information is to manage the customer relationship.

Den4Dogs will keep information about the Customer’s use of the Service confidential. Courts, prosecutors and other public authorities may nevertheless receive such information in cases where this is required by law, national regulations, as part of the debt collection case or as part of accounting processes.

Den4Dogs will also maintain and store the Customer’s transaction history and data from the user sessions. Examples of such history and data are information, statistics and analyzis about how long and how often the customer has used the den, how often, date and time, which dog and other relevant activity. The purpose is, to ensure optimization of the Service to the Customer. Den4Dogs also wishes to use this information to personalize the content of Den4Dogs App and the communication with the Customer. Den4Dogs will only contact Customer with information if Customer agrees to this.

In order to secure the Customer’s rights and personal data, Den4Dogs has committed to data-processing agreements with the third parties that access your personal information. These third parties will not be able to use your personal information for any purpose other than agreed between Den4Dogs and the Customer. Third parties are similarly obliged to commit into data processing agreement with their subcontractors.

Your personal information will not be processed by third parties outside the EU / EEA.

 

  1. Limitation of Liability

Den4Dogs is not responsible for damage or loss if:

•       A mobile network or associated operations does not work

•       A mobile phone network operator has modified their service so that it is not possible to perform transactions by Den4Dogs App

•       The service has been unavailable for reasons which have been found to be incorrect, but caused Den4Dogs at the time of the event had reason to believe was the reason for the event

•       A Smartphone / Tablet with Den4Dogs-App is lost / stolen and misused by others

•       There is an electronic or physical burglary in a Den4Dogs den.

Den4Dogs has no responsibility for making sure the Customer use the Service in accordance with the Animal Welfare Acts and laws. Den4Dogs has the right to carry out necessary interruptions and changes deemed necessary for technical, maintenance or operational reasons. Den4Dogs is not responsible for damage or loss resulting from emergencies, including force majeure, serious threats to health, safety and / or environment, natural disasters, war or warlike conditions, including strikes and lockouts, and serious danger of sabotage affecting the Service, failure or delay in telephone connections or other communications and transport, which is beyond Den4Dog’s control. The reservation for strikes, boycotts and blockades applies even when Den4Dogs is subject to such actions. In such cases, Den4Dogs has the right perform actions such as service close down, restrictions on service facilities and temporarily limit access to the Service. Den4Dogs is not liable for any loss which the Customer may incur as a result of the said measures.

 

  1. Intellectual property rights

All intellectual property rights (including but not limited to copyrights, trademarks and patents) to Den4Dogs App belong to Den4Dogs AS.

 

  1. Changes

In order to maintain the quality and improve the Service, Den4Dogs reserves the right to make changes to the Service.

Den4Dogs may also change terms of use, including introducing new rules, terms or conditions for the Customer’s use of the Service if Den4Dogs considers it necessary for further development of the Service. If the changes are important to the Customer, Den4Dogs will inform about these through a release of the new version of Den4Dogs App and changes to Den4Dogs dens.

It is optional for the Customer to agree to the changes. Den4Dogs reminds that, if Customer does not agree to the changes, Customer will immediately lose access to the Service and Customer’s User History. The customer will still be able to access “User Profile” so that the Customer can terminate his / her user account at Den4Dogs. If the Customer chooses to terminate the user account, all user history will be deleted and these will not be retrieved by creating a new user account.

If the Customer has not terminated his / her user account, Customer may at any time approve the changes under “Terms and Conditions”. The customer will then immediately be granted new access to the Den4Dogs App.

 

  1. Transfer of rights and obligations

The Customer may not transfer the Agreement, rights and obligations to others without a written consent from Den4Dogs.

Den4Dogs reserves the right to transfer all or part of our rights and obligations Den4Dogs has to the Customer, to another company. This could mean that your personal information will also be transferred to another company in accordance with applicable legislations.

 

  1. Disputes

The terms and conditions are governed by Norwegian law. Any dispute concerning the interpretation or application of the agreement shall be settled by Norwegian law and by Norwegian courts. Oslo District Court is appointed as the court of law for disputes concerning Den4Dogs terms and conditions.
